1. Scope of application


1.1 These General Terms and Conditions apply to all orders placed by customers on the MAISON BOANTON brand online shop, www.maisonboanton.com


1.2 The Website www.maisonboanton.com is operated by MAISON BOANTON SA (“Maison Boanton”), a company incorporated under the laws of France, having its registered business office at 10 BIS RUE DE LA SALLE 78100 SAINT-GERMAIN-EN-LAYE.


1.3 Maison Boanton can be contacted by post at the above mentioned address or by email at hello@boanton.com.

1.4 The General Terms and Conditions that are applicable for product orders are those in force on the date the order is submitted, in the version appearing on the Website on that date. When confirming your order, you will be asked to accept the General Terms and Conditions. Acceptance of the General Terms and Conditions is a necessary condition for processing your order. Maison Boanton reserves the right to update their policies whenever it deems necessary and at their own discretion.

2. Offer and conclusion of the contract


2.1 The presentation of the products in the online shop only represents an invitation to order and does not constitute a binding legally offer.

2.2 The products descriptions on our Website are only approximate and product images are for illustrative purposes only. While we make every effort to be as accurate as possible on our Website regarding products descriptions (including, without limitation, size, weight, capacity and dimensions) and to display the most accurate colours, any description is only approximate and we cannot guarantee that the colours displayed on our site reflect the exact colour of the products.

2.3 By clicking on the order button, the Customer undertakes to purchase all products listed on the order page.

2.4 All orders are subject to acceptance by MAISON BOANTON. Orders are considered as accepted once MAISON BOANTON communicates them to the shipment company. For direct order, orders can only be cancelled for a full refund within 10 hours after the order. For pre-order products, orders can only be cancelled for a full refund until the end of the pre-order period. Cancellation will not be possible after this step, but customers have a right to withdraw as described below.

2.5 All products presented on our website are subject to availability. If the product you have ordered is not available, we will inform you by e-mail as soon as possible and MAISON BOANTON will offer you (i) to secure payment for shipment for the next available batch, if any, or (ii) to be notified once the watch is back in stock.


2.6 Online sales via the Website are intended for end consumers of the products, not for resellers. MAISON BOANTON may at its sole discretion refuse an order if they suspect the purchaser is acquiring the products for resale.

2.7 Customers shall comply with all applicable rules. If the customer is subject to sale restrictions due to governmental measures regarding some sales products presented on the Website, he/she commits to not order it. MAISON BOANTON reserves the right to refuse the order if they have any doubt. The customer agrees to have MAISON BOANTON using the personal data provided by the customer in the process of the Order to carry out appropriate sale due diligence.

2.8 The customers are responsible for providing accurate and correct personal information for delivery and sale. All changes must be sent to hello@boanton.com. For direct order product, the customer delivery information (shipping address, contact information) can no longer be updated 10 hours after ordering. For pre-order products, the customer delivery information (shipping address, contact information) can only be updated until the end of the pre-order period. After this period, as we use an automatic fulfilment center, the item will be processed for picked, packed and delivered.  


3. Payment prices and terms

3.1 The prices applicable are those indicated at the date of order. They are indicated in Euros and without shipping fees. All change of VAT rate applicable will be automatically taken into account and included in the price of the Products. If one or many taxes and contributions, notable environmental, should be created or modified, increasing or decreasing, that change will be included in the price of sale of the Products.

Prices are firm and non negotiable.

The Seller reserves the right to modify his prices at any moment.

3.2 The price of the Products is paid cash, at the moment of validation of the order. To pay his order, the buyer disposes, at his discretion, of the entirety of the means of payment at his disposal by the Seller and listed on the Seller’s website.

From 100,00 Euros and up to 3.000,00 Euros of purchase, a payment in 2 or 3 installments without fees is offered to the buyer.

If he selects this option, the buyer is redirected towards the web page of Alma on which:

  • he will be informed of the entirety of the conditions applicable to this means of payment and of the amount of the payment installment
  • he will fill in his identification data necessary to the processing of his application and enter his credit card number.

The payments will be carried out in accordance with the conditions defined by ALMA which the buyer is invited to read attentively before approval.

In case of cancellation of an order, the installments already collected will be refunded.

It is reminded to the CUSTOMER that a credit is binding and must be repaid, the buyer being invited to check his ability to repay before committing himself.

The buyer guarantees to the Seller that he disposes of the necessary authorizations eventually necessary to use the means of payment chosen during validation of the order.

The Seller reserves the right to suspend all management of order and delivery in case of refusal to authorize payment by credit card by officially accredited organizations or in case of non-payment. The Seller notably reserves the right to refuse to proceed with a delivery or to honor an order coming from a buyer which would not have paid entirely or partially a previous order or with whom a payment dispute is being administered.

4. Delivery terms and conditions


4.1 In general, the delivery time is between 5 to 15 days, unless otherwise specified in the offer. The delivery time is given as an estimation only and is not binding. Depending on the country of delivery, it may take more time due in particular to customs inspections. MAISON BOANTON will not be liable for any delay due to an extension of the delivery deadline.

4.2 MAISON BOANTON offers the shipping cost.

4.3 All products will be shipped worldwide, with insurance and tracking references. We are not responsible for any import permit fees and/or other fees that couriers may add.

4.4 In the event some of the ordered products are not available, MAISON BOANTON is entitled to make partial deliveries.

4.5 In the event the product could not be delivered due to the customer’s fault, MAISON BOANTON is entitled to withdraw from the contract after two delivery attempts. In this case, any payments made will be refunded, subject to deduction of delivery costs and any others costs MAISON BOANTON had to bear in connection with the return of the product.

4.6 In the event the product could not be delivered due to the customer non-payment of customs fees, permit fees due to the remote or out of town area or if customs refuse the product for whatever reason,  MAISON BOANTON is entitled to withdraw from the contract. Any payments made will be refunded, subject to deduction of delivery costs and all others costs MAISON BOANTON had to bear in connection with for the return of the product.

4.7 Some shipping restrictions may occur with regard to certain national regulations. Before ordering, the customer shall make sure that there are no shipping restrictions in his/her country. MAISON BOANTON is not liable for any delivery problem due to national restrictions. If delivery is made impossible due to national restrictions, the order will be cancelled. The price will be refunded subject to deduction of delivery and any other fees. MAISON BOANTON does not deliver to P.O. boxes and such orders can be cancelled (some couriers cannot deliver to P.O. Boxes).

4.8 Shipments to Russia require a commercial address (need to be shipped to an office, company, etc) and cannot be shipped to a personal address. Therefore, we reserve the right to cancel the order. Due to shipping carriers restrictions area, some destinations are not covered, therefore we are not able to ship our products in those specific areas. You can access the full list of restricted countries by FedEx Express here. There are some restrictions also for Ukraine and Russia, our shipping carriers cannot currently ship our goods there.

 

5. Transfer of property


The product remains MAISON BOANTON’s property until it has been fully paid for and delivered to  the customer. Pledging, assignment by way of security, transformation or modification shall not take place prior to MAISON BOANTON’s transfer of ownership and without MAISON BOANTON’s consent.


6. Right of withdrawal



6.1 Customers have the right to withdraw from the contract within 14 days following receipt of the products. The withdrawal declaration must be notified in writing via MAISON BOANTON’s e-mail address. The dispatch date of the withdrawal declaration is relevant for compliance with the deadline. It is not necessary to state the reasons for cancellation. The withdrawal declaration must be sent to: hello@boanton.com

6.2 The withdrawal right is exercised in such a way that the sales contract is transformed into a cancellation, with the return of the services received under the contract. The customer is obliged to return the received product to MAISON BOANTON in the original packaging, the protective sticker on the glass of the watch must still be present, together with all supplied accessories (including straps, accessories, packaging, certificate of origin and all other papers), without any trace of use, and within 14 days from the withdrawal declaration to MAISON BOANTON. The returning costs of the watch are to be supported by the customer. Without all these conditions, the product has no resale value for a new customer.

6.3 You must use a trackable shipping service and purchase shipping insurance. If you do not use a tracking service and purchase a shipping insurance and that the product is lost, MAISON BOANTON will not refund you.

6.4 Once paid, the purchase price shall be immediately refunded to the customer, less the return costs upon receipt and inspection of the products, subject to a deduction from the price to be refunded in case of damage to the product or excessive wear and tear. MAISON BOANTON has the right to hold the refund until the product has been returned or until the customer provides proof that the goods have been returned, whichever comes first.

6.5 Withdrawal rights are not applicable to limited edition watches and it will be communicated as such on the Website. This exception is due to the fact that limited editions are only sold for a specific period of time and cannot be sold again after a potential return. Pre-orders limited by time cannot be refund after the pre-order selling period, due to the fact that we need to produce the watches with the funds received. However, our customers have the right to be refunded before the end of the pre-order period.


7. Warranty and liability



7.1 MAISON BOANTON guarantees that the products comply with the promised qualities, are free from defects that may affect their value or fitness for purpose and that they correspond to the intended performance and specifications.

7.2 MAISON BOANTON provides the customer with a warranty against manufacturing defects or hidden defects within 2 years as from the date of delivery of the product. Any claim for manufacturing defects or hidden defects must be submitted within 48 hours from the date of delivery of the Products or, in case of hidden defects, from their discovery. Our customer service is available at hello@boanton.com.

A manufacturing defect and/or a hidden defect notified in the above mentioned delay shall allow for the replacement or reparation of the defective product or a refund of the paid price, at MAISON BOANTON’s sole discretion, by MAISON BOANTON and at MAISON BOANTON’s costs (except the shipping cost of the defective product to MAISON BOANTON which shall be at the customer’s cost).

The customer must then return the damaged or defective product to MAISON BOANTON (in its original packaging), to the address that MAISON BOANTON will communicate at a later stage.

7.3 MAISON BOANTON shall not be liable for any damage caused by a misuse of a product. Excessive shocks or vibrations, exposure to strong electromagnets and similar activities can cause damage to or affect the functions. 7.4 You must use a trackable shipping service and purchase shipping insurance. If the product is lost, due to the fact that you do not use a tracking service and do not purchase a shipping insurance, MAISON BOANTON will not refund you.

7.5 The warranty does not include straps and accessories.

 

 8. Disclaimer



Despite all the care taken in preparing the Website, it may contain inaccurate or incomplete information. MAISON BOANTON is not responsible for any errors or omissions in the images or descriptions of the products on the Website. MAISON BOANTON shall not be liable for any direct or indirect damage resulting from interruptions of the Website, from the occurrence of bugs hindering the navigation of the Website or from any other technical problems (including the possible presence of viruses or other harmful elements). MAISON BOANTON accepts no responsibility for the content of third-party websites that may be accessible from the Website or linking to their Website by means of hyperlinks. MAISON BOANTON has no control over the content of these external sites.


9. Force majeure



MAISON BOANTON shall not be liable for failure to execute an order due to force majeure. Force majeure is any circumstance beyond the control of MAISON BOANTON, including, but not limited to, major business disruptions, accidents, labour disputes, late or defective deliveries of raw materials or semi- or fully manufactured products, restrictions imposed by the authorities, epidemics, pandemics, fires, floods or other natural disasters.

 

10. Personal data



When you create a customer account on the Website, you are asked to provide us with information about yourself, such as your name, email address, billing address, delivery address and payment details. You agree to provide us with accurate and complete information. You also send us personal data when you send us a message via the contact form available on the Website or by email. MAISON BOANTON undertakes to confidentially treat your personal data. Please refer to our Privacy Policy for information on how MAISON BOANTON i collects, uses and protects your personal data.


11. Intellectual Property



MAISON BOANTON brand is a protected trademark and cannot be used and reproduced without MAISON BOANTON’s express written consent. The content and structure of the products displayed by MAISON BOANTON, as well as the entire internet offers, are protected by copyright. The use of articles and work tools for personal use by the customer is permitted, however their commercial distribution in part or whole requires the express permission of MAISON BOANTON.


12. Place of jurisdiction and applicable law


The applicable law to the current terms and conditions is French law.


13. Final provisions



Should individual provisions of these general terms and conditions be ineffective, the validity of the remaining provisions shall not be affected.
